GENERAL TERMS AND CONDITIONS

1.1 Definitions

In these terms and conditions the following terms shall have the following meanings:

  • Agreement: The purchase and delivery agreement between Elite Zoanthus and the customer.
  • Customer: The natural or legal person who places an order with Elite Zoanthus.
  • Products: The zoanthus corals and other aquarium products offered by Elite Zoanthus.
  • Website: www.elitezoanthus.nl

1.2 Application

These terms and conditions apply to all offers and agreements between Elite Zoanthus and the customer. By placing an order, the customer accepts these terms and conditions. Elite Zoanthus reserves the right to refuse orders without giving a reason.

1.3 Offers and conclusion of the agreement

All offers on the website are non-binding. The agreement is concluded when Elite Zoanthus confirms the order by email. Elite Zoanthus reserves the right to reject orders.

1.4 Prices and payment

All prices include VAT. Payment must be made in advance using the available payment methods. Payment must be made within 3 business days of placing your order; otherwise, the order will automatically be canceled.

1.5 Delivery and execution

Elite Zoanthus strives to fulfill orders quickly. Delivery times are indicative and not guaranteed. In the event of unforeseen circumstances, delivery time may be extended. The customer will be notified of this.

1.6 Retention of title

The goods remain the property of Elite Zoanthus until full payment has been received.

1.7 Cancellation and returns

Live animals cannot be returned in accordance with European Directive 2011/83/EU. For other products, you have a 14-day right of withdrawal after receipt, provided the products are unused and in their original packaging.

1.8 Warranty and liability

DOA (Dead On Arrival) warranty is valid for a maximum of 2 hours after receipt.
Only applies to correctly received live zoanthus corals.
Damage caused by incorrect acclimatization, water conditions, pests, or medications is not covered by the warranty.

Elite Zoanthus' liability is in all cases limited to the amount of the order in question.
Elite Zoanthus is not liable for any indirect or consequential damages or damage to other corals or the customer's aquarium.

1.9 Complaints procedure

Complaints about DOA must be reported within 2 hours of delivery, with clear photos or videos.
Other complaints must be reported within 48 hours of delivery.
Claims outside this period will automatically expire.
Elite Zoanthus will assess complaints within 5 working days.

1.10 Disputes

Disputes are initially resolved through negotiation. If this fails, disputes can be submitted to the competent court in the Netherlands.

1.11 Force Majeure

Elite Zoanthus is not liable for failure to fulfill obligations due to force majeure, including: natural disasters, war, terrorism, pandemics, and other unforeseen circumstances beyond the control of Elite Zoanthus.

1.12 Applicable law

These terms and conditions are governed by Dutch law.

1.13 Copyright & Use of Photos

All photos, images, and content on this website are the property of Elite Zoanthus or its suppliers. Use, copying, or distribution of these images without permission is prohibited.

In case of unauthorized use of one or
multiple photos will incur a fixed fine of €50 per photo per use
charged.


If the photos in question are kept for more than one day without permission
remain published, the fine will be increased by €15 per photo per additional day
that the violation continues.


These fines are immediately due and payable.

PRIVACY POLICY

2.1 Controller of data processing

Elite Zoanthus is responsible for processing personal data. For questions about the processing of your data, please contact elite.zoanthus@gmail.com.

2.2 Collection of personal data

Elite Zoanthus collects personal data necessary for:

  • Processing orders
  • Shipping of products
  • Communication with customers
  • Compliance with legal obligations

Data will not be provided to third parties without permission, except for shipping partners and payment providers.

Personal data will only be used for the purposes for which it was collected. Elite Zoanthus will not send unsolicited marketing emails without permission.

SHIPPING AND DOA POLICY

3.1 Shipping Policy

Shipping is at the customer's risk, unless damage is demonstrably caused by improper packaging or handling by Elite Zoanthus. This shipping risk also applies to replacements.

3.2 DOA Warranty

DOA (Dead On Arrival) means a product arrives dead. Elite Zoanthus offers a DOA guarantee for live zoanthus corals within 2 hours of receipt. This guarantee applies only to properly received products. Damage caused by improper acclimatization, water parameters, pests, or medication is not covered by this guarantee.
